The Digital Market Acts (DMA) has been published in the Official Journal of the European Union and will enter into force on 1 November 2022. The DMA aims to address concerns regarding “contestability” and “fairness” in the digital economy and introduces several per se prohibitions and obligations on “big tech”.
DMA should create equal conditions for all market participants. These are the rules for big online platforms that like to abuse their market position. Such companies are also called “gatekeepers”. Under the DMA, the European Commission will designate as “gatekeepers” certain providers of “core platform services” that fulfill several criteria.
To be selected as a gatekeeper, a company must either have annual revenues of at least 7.5 billion euros in the EU over the past three years or a market capitalization of at least 75 billion euros. The Gateway must also have at least 45 million monthly and 10,000 business users registered in the EU.
After the specific “gatekeepers” are assigned, they will have six months to comply with the DMA obligations. This is likely to be as of March 2024.
